Terms and Conditions
Provider: Ecnecil s.r.o. · https://fibrz.app
These Terms apply to Clients and platform users. Separate agreements also govern cooperation with Trainers and Operators.
1. Definitions
Provider / Ecnecil / fibrz: Ecnecil s.r.o., company ID 03165914, VAT ID CZ03165914, Lýskova 2072/55, Stodůlky, 155 00 Prague 5, Czech Republic, registered with the Municipal Court in Prague, Section C, File 227920. Service: the fibrz.app website and application. Client: a person ordering a Scan, Activation or Training; a natural person acting outside their trade is a Consumer. Trainer: a person or business performing the booked professional service. Operator: a person managing a practice or team in the application. User: any person using the Service. Scan: the muscle assessment and mapping offered through the Service. Activation: a follow-up exercise or activation visit. Training: a course or educational content. Visit: a booked Scan or Activation. Order: an electronic order through the Service.
2. Acceptance and formation of contracts
An account agreement is formed when registration is confirmed after these Terms are made available. A paid service contract is formed when Ecnecil confirms the Client's submitted Order. Browsing the site alone does not amount to acceptance. We send the Order confirmation and its terms by email. Before the Client submits an Order, we show the total price including taxes and fees, seller, principal features, time, cancellation terms and withdrawal information. The order button clearly indicates an obligation to pay. The Terms applicable when the Order is formed continue to govern that Order. Mandatory consumer rights remain unaffected.
3. Seller and professional delivery
Unless an individual offer clearly identifies another seller before purchase, Ecnecil is the contractual seller to the Client and accepts payment and issues the document for that sale. The named Trainer performs the Scan or Activation and is responsible for their professional conduct and qualifications. When Ecnecil is the contractual seller, the Client may bring claims for defective or undelivered service to Ecnecil; internal arrangements with the Trainer do not limit this right. Ecnecil provides Training to the extent stated in the offer; any practical Visit is performed by the Trainer. Trainer and Operator use and payment arrangements are separately agreed.
4. Website and application
The Service includes the public site, Trainer profiles and booking pages, and logged-in Client, Trainer and Operator areas. A booking started on a public profile is subject to these Terms when the Client accepts them in the ordering process.
5. Accounts and age
Users provide accurate details, protect credentials and report suspected misuse. A person may register an account independently from age 18. A service for a minor is ordered by their legal representative, and we handle the minor's data in accordance with the law. We may suspend access for a serious breach, security risk or legal requirement under section 24.
6. Trainer, Operator and Client responsibilities
The Trainer is responsible for their qualifications, professional assessment, instructions and their own data protection duties, including appropriate notices and any required explicit health data consent for their purposes. The Operator is responsible for practice information and the settings they manage. Ecnecil's obligations as contractual seller, where applicable, are unaffected by a Trainer's professional responsibility. A Client should provide relevant information accurately and understands that a Scan, Activation and Training do not replace urgent or specialist medical care.
7. Health and product information
The Service is not an emergency service or a substitute for medical care. Activation scores, body maps and educational materials support human assessment. These Terms do not determine the regulatory classification of software or a connected device. Seek appropriate medical help in an emergency.
8. Booking and Visit record
Bookings are made through the Service. An unpaid booking may expire after the period shown when booking. A Trainer's “completed” status is an operational record, not conclusive proof of proper delivery. A Client can still claim that a service was defective or not delivered. Sections 11–14 cover cancellation, withdrawal, complaints and rescheduling.
9. Client payments
The Client pays Ecnecil for a Scan, Activation or Training when Ecnecil is identified as seller. The checkout shows the price, currency and tax. Contract formation follows section 2; payment and booking confirmation timing must be shown at checkout. Ecnecil issues the invoice or other required tax document. The available payment methods are displayed in the Order. An unpaid booking may expire after the period shown when booking.
10. Trainer settlement
The Trainer's remuneration and platform fee, including its calculation basis, VAT treatment, documents and cancellation allocation, must be agreed before cooperation and shown in the Trainer's settlement. Marking an actually performed Visit “completed” starts settlement; a substantiated dispute may justify a proportionate hold on the disputed amount under the Trainer agreement. An undisputed amount is paid within 14 calendar days of that record. The Trainer provides accurate bank details. Fee changes do not apply retrospectively to existing Orders. Internal settlement within a practice is its own responsibility.
11. Cancellation and statutory withdrawal
| Event | Ordinary contractual treatment |
|---|---|
| Client cancels at least 24 hours before the Visit | Full refund |
| Client cancels less than 24 hours before the Visit or does not attend | A reasonable, previously disclosed cancellation fee may apply, up to the Visit price; statutory rights remain |
| Trainer cancels | Full refund or an agreed replacement date |
| Trainer marks the Visit complete | Operational record; defect and non-delivery claims remain possible |
The 24 hours run back from the Visit's scheduled start in its displayed time zone. Cancel in the application or by emailing [email protected] if the application does not allow it. Any late cancellation fee is shown before the Order is submitted and is subject to mandatory consumer law. Cancellation is distinct from a complaint about defective service.
A Consumer may have a 14-day statutory right to withdraw from a distance contract. Where a service begins at the Consumer's express request during this period, they may owe a proportionate amount for performance already provided. For a fully performed service, the right ceases only if the legal conditions, including the Consumer's prior express consent and acknowledgement, are met. Withdrawal information and a model withdrawal form are available before the Order; no cancellation clause overrides mandatory rights.
12. Refunds
Request a refund in the application if available or at [email protected] with the Order or Visit details. We do not require an excuse where the stated cancellation rules apply. We notify the Client of the decision. An owed refund is made without undue delay; on statutory withdrawal, no later than the legal deadline of 14 days after notice, generally using the original payment method unless otherwise agreed without extra costs. For paid digital content or services, loss of a withdrawal right after immediate access depends on the specific legal conditions, the Consumer's express request/consent and recorded acknowledgement; mandatory defect rights remain.
13. Complaints
Send complaints about payment, platform access, the Visit or its professional delivery to [email protected], with the Order and a description. We confirm receipt and resolution to a Consumer. A Consumer complaint, including remedy, is handled and reported within 30 days of submission unless a longer period is expressly agreed. Lack of a hoped-for subjective result alone need not be a defect; deficient or undelivered promised performance can still be claimed against the contractual seller, even when a Trainer carried it out. Remedies follow the applicable law and circumstances.
14. Rescheduling
Ask at least 24 hours in advance through the application or support. A new date requires confirmation. A later request may be subject to the reasonable fee disclosed under section 11 unless a new date is agreed. A completed Visit cannot be rescheduled retrospectively, but defect and non-delivery rights remain.
15. Payment disputes
Please contact support before a card or bank dispute so we can investigate promptly. This does not restrict the right to challenge a payment with the bank. A disputed Visit or an appropriate refund may be reflected in Trainer settlement under their separate agreement.
16. Training access
The offer states the price and scope of access. Access begins after payment or as specified at checkout. Before access or performance begins, cancellation gives a full refund under the stated policy. After access, statutory withdrawal and defect rights under section 12 apply. The timing and cancellation conditions for a live course are stated in its offer before purchase.
17. Intellectual property
Training materials, including MFK materials, software and branding are protected by applicable intellectual property rights. Users receive a limited, non-exclusive, non-transferable right to use content for its intended licensed purpose. Unauthorised copying or redistribution is prohibited subject to statutory exceptions. Visit records and personal data are handled under the Privacy Notice; intellectual property terms do not grant use of Client health data for unrelated purposes.
18. Acceptable use and reviews
Do not breach security, access another account, overload the Service, upload unlawful material, misrepresent qualifications or use Client health data unlawfully. Restrictions on reverse engineering apply only to the extent allowed by mandatory law. Knowingly false statements that infringe another's rights are prohibited. Truthful reviews, criticism, complaints and reports to authorities are allowed. We may remove unlawful content or proportionately restrict access where required for safety or legal compliance.
19. Privacy and cookies
See the Privacy Notice and Cookie Policy, including how Client and Trainer data are handled.
20. Availability
We use reasonable efforts to keep the Service available and remedy faults. If downtime prevents delivery of a paid service, the response follows the contract and law and may include restoring access, a replacement Visit, a price reduction or refund. Continuous availability is not guaranteed; changes and planned maintenance will be communicated reasonably where possible. Users bear their own device and connection costs.
21. Liability
The Trainer is responsible for their professional conduct. Ecnecil's statutory and contractual responsibilities, including as seller to a Consumer where applicable, remain. Liability and remedies follow applicable law. Any limit for business Trainers belongs in an individually agreed contract and cannot limit mandatory consumer rights or liability that the law does not allow to be excluded.
22. Trainer and Operator indemnity
A Trainer or Operator who breaches their own obligations may be liable to Ecnecil for proven loss in the extent allowed by law and their separate agreement. This does not diminish the Client's claims against the contractual seller.
23. Marketing
Marketing emails are sent on consent or, where legally allowed, for comparable own services to existing customers. A simple opt-out is available when collecting the address and in every message. Necessary transactional messages about Orders, payments and security are separate.
24. Suspension and termination
Users may stop using the Service and request account deletion under the Privacy Notice. We may proportionately suspend or terminate access for serious breach, immediate security risk or a legal requirement; where possible, we explain the reason and offer a chance to remedy it. Paid services and Client rights are settled under law. Provisions that by their nature survive termination remain effective only as needed.
25. Governing law and disputes
Czech law applies, subject to mandatory consumer protection and jurisdiction rules. A Consumer may seek alternative dispute resolution before the Czech Trade Inspection Authority, where competent: https://adr.coi.cz and https://www.coi.gov.cz. The EU ODR platform closed on 20 July 2025.
26. Communications
Ordinary electronic communications use [email protected], the address provided in the Order or profile, or the application. Legally required formats and confirmations remain applicable.
27. Changes
We may amend these Terms for future use. We will give at least 30 days' notice of material changes by email or in the application where appropriate, and allow termination where required. Existing Orders retain the version accepted when formed; new acceptance is sought where the law requires it.
28. Severability
If one provision is invalid, the remaining provisions continue to apply to the extent possible under law.
